Terms & Conditions
By enrolling a student in a program run by The Band Collective (“we”, “us”, “our”), the enrolling parent or guardian (“you”) agrees to the following terms and conditions.
1. Eligibility & Enrolment
- Our Primary Program is open to students from Year 3. Our High School Program is open to students in any high school year level.
- Enrolment is confirmed once we receive a completed enrolment form and any required instrument trial has taken place.
- We reserve the right to decline an enrolment application at our discretion.
2. Program Structure
- Primary Program: students attend one weekly band rehearsal and one small-group tutorial during term.
- High School Program: students attend one weekly band rehearsal. Small-group tutorials are not included, and students are expected to already hold foundational skills on their instrument.
- A performance may occasionally replace a scheduled rehearsal where they fall on the same day.
- Make-up sessions may be scheduled when whole school activities occur on band days.
3. Instruments
- All students are required to have a suitable instrument in time for their first tutorial or rehearsal.
- Depending on the instrument, families may either hire directly through The Band Collective or arrange their own hire or purchase (with our advice).
- Each student (or their family) is responsible for the ongoing care, maintenance and safe transport of their instrument, whether hired or owned.
- Hire instruments are subject to our separate Hire Instrument Policy, which sets out care, loss, damage and insurance arrangements.
- Percussion equipment (such as the glockenspiel and drum kit) is supplied by the school or by The Band Collective for use at school. Families may wish to purchase a drum kit or other items to assist practice at home. All students will need their own sticks/mallets for use at school.
4. Commitment & Term Structure
- Families are asked to commit to a minimum enrolment period of a term.
- Term dates, rehearsal weeks and performances are scheduled with the school and any changes will be communicated by email or text message.
- Enrolments roll over automatically from term to term and year to year unless we’re notified of a withdrawal in line with Section 7 below.
5. Attendance & Absences
- It’s the student’s responsibility to attend all scheduled tutorials and rehearsals at their allocated time.
- If your child will be absent, please notify us by email in advance where possible.
- Missed group tutorials and rehearsals are not made up, except where the whole group is away for a whole-school event (such as an athletics carnival).
- For extended absences (such as illness, injury or overseas travel), please notify our office as early as possible. Fees are reviewed on a case-by-case basis.
6. Fees & Payment
- Program fees are calculated and invoiced each term. Fees cover all scheduled tutorials and rehearsals for the term; optional extras (such as workshops or band camps, where offered) attract a separate fee, communicated at the time of registration.
- Invoices are issued ahead of each term, with payment due before the start of the term.
- Payment can be made via [direct deposit / online payment portal / credit card].
- Program fees are non-refundable, including for missed tutorials, rehearsals or performances.
- Late payments will incur a fee of $5 per week until paid. Reminder emails will be sent for any unpaid fees, and non-payment may result in exclusion from program activities at our discretion.
7. Withdrawal & Cancellation
- To withdraw a student from a program, please notify us in writing by completing the Withdrawal Form before the end of the current term, to avoid being charged for the following term.
- There are no refunds for withdrawal, change of mind, or change of circumstances once a term has begun.
- Year 6 students (Primary Program) and final-year high school students automatically exit the relevant program at the end of their final year.
8. Student Expectations & Code of Conduct
- Bring their instrument and all relevant music to every tutorial, rehearsal and performance.
- Attend all scheduled tutorials, rehearsals and performances.
- Practise their instrument at home on a regular basis.
- Behave appropriately and respectfully at all times during The Band Collective activities.
- Follow their school’s Code of Conduct at all times while participating in The Band Collective programs.
- We reserve the right to refuse or terminate a student’s participation at any time, at our discretion, where conduct or attendance falls short of these expectations.
9. Student Welfare & Supervision
- The Band Collective and its Tutors are responsible for students only during scheduled tutorials, rehearsals and performances. We do not take responsibility for students outside these times.
- Please notify us of any medical conditions, allergies or additional needs that may require support during our sessions.
- All The Band Collective Tutors and staff are required to hold a current NSW Working With Children Check, in line with the NSW Child Safe Standards.
10. Photography, Recording & Marketing
- We may occasionally use group photos or videos taken at rehearsals, performances or other events on our website, social media or other marketing materials.
- By enrolling your child, you agree that The Band Collective may photograph or film them for these purposes unless you tell us otherwise. If you do not want your child included, please contact us in writing with your child’s name and school. Your child may still take part in performances, but we will make reasonable efforts to avoid featuring them in our own promotional content.
- We’re not able to control filming or photography by other parents, schools, or third parties at shared events such as school assemblies or concerts.
11. Health & Safety
- Please keep us informed of any illness, injury or condition that may affect your child’s participation, so we can support them appropriately.
- Where a public health matter (such as an infectious illness outbreak) affects a school or venue, we may need to adjust, postpone or move sessions online at short notice.
- Students must not share instruments, mouthpieces or reeds.
12. Liability
- To the maximum extent permitted by law, The Band Collective is not liable for loss, damage or injury arising from a student’s participation in our programs, except where caused by our negligence.
- The Band Collective holds public liability and professional indemnity insurance appropriate to the activities we deliver.
13. Privacy
- We collect and hold personal information (including student and family contact details, and any relevant medical information) in order to deliver our programs and handle it in line with our Privacy Policy. We do not share your information with third parties except as needed to run our programs, or as required by law.
- Records relating to child safety — including any complaint, disclosure or incident involving actual or alleged child abuse — are retained for at least 45 years from the date the record was created, in line with the recommendations of the Royal Commission into Institutional Responses to Child Sexual Abuse and the NSW Child Safe Standards.
14. Changes to These Terms
- We may update these Terms & Conditions from time to time and continued enrolment in our programs after an update means you accept the revised terms.
